Separate declaration, treaty and domestic law

  • Human rights belong to people because they are human, not because they have citizenship or have performed every duty. The UDHR is a UN declaration adopted in 1948, distinct from a treaty and from a domestic Act.
  • The ECHR is a Council of Europe treaty, distinct from the European Union. The Human Rights Act 1998 gives domestic effect to specified Convention rights; the UNCRC is a separate treaty about children’s rights, with domestic implementation depending on jurisdiction.

Identify rights and their legal sources

  • Civil/political rights include expression, fair trial and participation; social/economic rights include areas such as education, work and health. Categories can overlap and a right’s source, scope and remedy must be identified.
  • The rights of a person seeking asylum or accused of an offence do not disappear because of their status. Under the taught Convention basis, a refugee is outside the relevant country with a qualifying persecution fear and protection need; an application-based asylum seeker awaits a final decision.

Distinguish absolute and qualified rights

  • The ECHR Article 3 prohibition of torture and inhuman or degrading treatment/punishment is absolute: it cannot be justified by saying that security benefits outweigh it. Not every uncomfortable experience reaches the legal threshold.
  • Qualified rights such as privacy, expression and peaceful assembly may face restrictions only under their legal tests. Ask about lawful basis, a permitted aim, necessity and proportionality; disagreement or official convenience alone is insufficient.

Use the full protected-characteristic labels

  • The Equality Act 2010 is the main equality framework for Great Britain; Northern Ireland has separate equality arrangements. The Act names age, disability, gender reassignment, marriage and civil partnership, pregnancy and maternity, race, religion or belief, sex and sexual orientation.
  • Protection differs by characteristic and context, with relevant tests and exceptions. The list alone does not resolve every case, and equality does not always require identical treatment where appropriate adjustments are needed.

Keep all nine statutory labels complete

Distinguish discriminatory treatment and practices

  • Direct discrimination concerns less favourable treatment linked to a characteristic under the relevant test; indirect discrimination can arise from an apparently common rule that disadvantages a protected group and the individual. Justification and statutory exceptions depend on the context.
  • Original fictional example: a venue says the same stairs are available to everyone, but a wheelchair user cannot enter. Identical provision does not establish equal access; examine the applicable reasonable-adjustment duty and facts rather than announce a complete legal verdict from one sentence.

Separate legal duties and civic choices

  • Complying with applicable law, paying taxes where legally liable, responding to eligible jury summonses and respecting others’ rights are responsibilities. Jury deferral/excusal uses formal procedures; the duty is not unqualified for every learner.
  • Voting is not compulsory in the UK, though eligible people may choose it as civic participation. Failure to fulfil a duty does not erase all human rights, and rights do not require agreement with the government.

Analyse an original fictional privacy proposal

  • Original imagined proposal: a council wants cameras near a public entrance following reported thefts. No legal basis, evidence of effectiveness, access rules or retention period is yet supplied. Safety is a possible purpose, not a sufficient justification by itself.
  • Ask whether the measure is lawful and pursues a permitted aim, whether evidence supports need, and whether scope, positioning, access and retention are proportionate. Consider less intrusive alternatives and give a conditional judgement rather than invent missing facts.

Identify institutions and remedies accurately

  • The EHRC promotes equality/human rights and has statutory powers within its remit, including equality enforcement in Great Britain. Courts and tribunals decide relevant claims; other UK rights/equality institutions have their own remits.
  • Under the Human Rights Act, courts can consider specified Convention-rights claims and legal remedies. A declaration of incompatibility does not itself invalidate an Act of the UK Parliament; distinguish that mechanism from automatically striking down every disputed law.

Evaluate evidence and the role of NGOs

  • Amnesty International and Human Rights Watch research and campaign about rights abuses as NGOs. Their material can provide evidence to examine, but an NGO report is not itself a binding court judgment or a substitute for checking facts and jurisdiction.
  • For a rights question, identify the person affected, legal source, relevant duty and evidence, then explain the remedy or qualified-right test. Keep absolute protection distinct, consider alternatives and state what remains uncertain.
