Separate attitudes, stereotypes and treatment

  • Prejudice is a prejudgement about a group; a stereotype is an oversimplified generalisation that overlooks differences within it. Discrimination concerns treatment, which can include decisions, rules and organisational practices.
  • An openly prejudiced statement is not necessary for a discriminatory process. Conversely, a group difference alone does not establish its cause or prove a legal breach; examine the decision and relevant evidence.

Measure a pay gap carefully

  • Define the group, date and measure. An ONS-style median hourly comparison excludes overtime; the median is the middle pay value, not the total wage bill divided by workers. Do not mix annual, hourly, full-time and all-employee figures.
  • Original fictional medians: men £20 per hour, women £18. The gap relative to men is (20 − 18) ÷ 20 × 100 = 10%. This does not show that each woman is paid 10% less than a man doing equal work.

Use the correct equality-law scope

  • The Equality Act 2010 is the main framework here for Great Britain; Northern Ireland has separate equality legislation. The nine named characteristics are age, disability, gender reassignment, marriage and civil partnership, pregnancy and maternity, race, religion or belief, sex and sexual orientation.
  • Protection depends on the conduct, setting and applicable tests or exceptions. Equal pay concerns suitable comparators doing like work, work rated equivalent or work of equal value; the Equal Pay Act 1970 is an earlier historical law.

Distinguish direct and indirect discrimination

  • Direct discrimination generally involves less favourable treatment because of a protected characteristic, subject to the legal context. Indirect discrimination concerns a shared rule that particularly disadvantages a protected group and the individual without objective justification.
  • Original example: inflexible evening-only development training may exclude carers. Check who is disadvantaged, whether a protected group is particularly affected, the business aim and less restrictive alternatives; the short scenario does not establish a court verdict.

Explain organisational and intersecting barriers

  • Occupational segregation concerns concentration in different jobs; a glass ceiling describes barriers to senior roles. Caring patterns, access to training, recruitment practices and discriminatory assumptions can interact, so a single explanation need not fit all settings.
  • Intersectionality examines how social positions and systems interact. A low-paid carer facing racialised assumptions may encounter a pattern not captured by examining each dimension alone; do not assume all members of a group share that experience.

Read historic evidence in context

  • The 1999 Macpherson inquiry into the Stephen Lawrence investigation identified institutional racism in the Metropolitan Police. Institutional racism concerns organisational processes and practices, including failures in service, rather than only openly hostile individuals.
  • A historic report supports claims about its investigated context. To assess present conditions or another organisation, seek current evidence about procedures, outcomes and experiences; the report alone cannot establish them.

Recognise hate crime without overclaiming

  • The CPS England and Wales framework concerns criminal offences involving demonstrated or motivating hostility based on race, religion, disability, sexual orientation or transgender identity. Motivation need not be the only route to establishing the hostility element.
  • A disagreement or offensive view alone is not automatically a hate crime. Recording an allegation is also different from proving an offence; evidence and the applicable legal tests matter.

Choose lawful and practical responses

  • Positive action may proportionately address disadvantage, different needs or under-representation, for example targeted outreach or development opportunities. It is not blanket permission to prefer an under-represented applicant over a clearly better qualified person.
  • Pay audits, transparent criteria, accessible reporting, reasonable adjustments and workable flexibility can tackle specific barriers. Assess quota proposals in their legal context; training and campaigns should connect to changes in everyday practice.

Evaluate access, decisions and outcomes

  • Original fictional project: 40 staff attend training and 8 volunteer to review recruitment. These are participation outputs, not proof that discriminatory treatment fell; investigate selection decisions, experiences and reporting access over time.
  • Compare relevant outcomes with an appropriate baseline and examine alternative explanations. Equality can require removing different barriers rather than identical provision, while diversity in headcounts does not itself prove inclusion or equal power.
